TERMS OF SERVICE

THINGS TO NOTE BEFORE COMMISSIONING ME

Updated as of december 13, 2022

  • Please provide an existing character description, image or design sheet of your character.

  • You needs to be 100% sure before placing an order to avoid the hassle of doing refunds, this includes Paypal's fees for refunds.

  • Each artwork will normally have a maximum of 2 revisions. So inform me of all the errors or changes you want to be fixed/changed and I'll do it as soon as possible.

  • PSD adjustments requested by the client during the Work In Process phase will count as revision and may require additional charge depending on the scale of the adjustment (e.g.: adding hair, replacing parts, etc).

  • Commissions are for personal/non-commercial use only. But you can pay for the commercial use.

AS THE ARTIST, I...

  • Maintain the right to post my work in any form.

  • Maintain the right to stream commissions on my Streaming Channels, like Twitch or Youtube.

  • Maintain the right to post commissions to my social medias for advertising and/or portfolio purposes, with respective credits to the client.

  • Have the right to turn down any commission or requests that I am uncomfortable with or not confident enough to do.

  • Have the right to turn down commissions forcing me to copy another artist's art style.

  • Will not be held responsible for any misconception if the commissioner did not read my Terms of Service thoroughly.

AS THE CLIENT, YOU...

  • May stream or make monetized creative content using the illustration to your preferred media platform.

  • Should ALWAYS credit me as the Louback Lavoura (Ilustrator) and should be seen on easily-accessible places such as your Twitter bio, channel, and/or website.

  • May request small revisions like color changes to finished piece. Large revisions and redraws must be paid for.

  • Can give me any directions, poses and details that you want in the picture and I'll do my best to follow them.

  • Are NOT allowed to ask me to keep the commission private or not post it anywhere unless you've paid for a privacy fee.

  • Are NOT allowed to redistribute the psd file.

  • Are NOT allowed to reuse the parts for personal or commercial use.

delivery time

  • The delivery time must be negotiated before the first payment

  • Pay attention to what slots you are buying. e.g.: If I advertise a slot as "May slots are open" in April, it means that your order will start in May, not April, and will follow the delivery time negotiated, starting the "countdown" in May.

  • Although the delivery time is long, I receive many orders at once, for this reason this forces me to extend the deadline for some orders.

  • When the artwork is done, You will receive a low quality watermarked finished piece, when the 2nd part of the payment is done, I'll send the full artwork with high quality and with no watermarks.

  • My current turn around time without rush order is between 1 month to 6 months (at the longest) with possible extensions depending on the complexity of the commission.. Please note that I am human too so I will have times where I will get sick or be faced with personal matters which'll interrupt my workflow. However if anything was to happen I will reach out to you personally to let you know.

  • More parts and/or features on the illustrations mean it will take longer. Please note that there will also be possible delays on the client's side when it comes to communicating.

  • I won't be working on weekends to give myself a break and prevent burnout (and back pain lol).

  • Please do not rush me, I do not appreciate that as well as it’ll only add more pressure and stress to me, resulting in an unsatisfying final product.

  • However if anything was to happen I will reach out to you personally to let you know.

  • Commissions do not have an immediate deadline unless this was discussed prior to payment. I do not accept any sudden deadlines after payment, and you will be expected to pay a rush fee.

  • I will not accept commissions that include a deadline of 1 week or less.

  • I will try my best to inform you if something comes up and if there is a delay with your art piece. I will, usually, update it both publicly and privately.

  • Your commission will most likely be posted on my social medias after finalized. There is also a chance I'll keep it up on my website as a commission example, or use it anywhere else to promote my art.

Waitlist

  • Reservation Policy: Clients intending to book commission slots for artwork agree to abide by the following terms and conditions.

  • Advance Payment: A minimum of 50% of the total commission fee must be paid in advance to secure a slot. No reservations will be considered confirmed until this payment is received.

  • Cancellation Policy: Clients retain the right to cancel their reservation, however, any advance payment made is non-refundable. Cancellations must be communicated at least 30 days prior to the agreed-upon start date of the commission work.

  • Rescheduling: Clients may request to reschedule their commission slot, subject to artist availability. However, such requests must be made at least 30 days in advance. Rescheduling is at the discretion of the artist and may incur additional fees.

  • Revision Policy: A reasonable number of revisions are included in the commission fee. Any major revisions or changes requested beyond the agreed-upon scope may incur additional charges.

  • Legal Compliance: Clients are responsible for ensuring that their commission requests do not infringe upon any copyrights, trademarks, or other intellectual property rights.

payment / order

  • The prices are per character.

  • Very complex characters, concepts and background can cost a few extra dollars.

  • Commissions are NOT first come, first served. I will review each application and will contact those that I've accepted.

  • Due to a lot of people sending in applications, I will not be able to contact those who I didn't accept. In any case your application didn't get accepted, I highly recommend commissioning other talented artists.

  • Commissions will be worked on one or two at a time! I'll reopen my commissions once I'm done. This prevents long wait periods for those who would rather opt to find other artists to commission.

  • I'll only work on the commissions that are in the initial invoice. For newly-added features/add-ons to the commission that are not included in the initial invoice, you may have to submit another application form once I reopen and start accepting commissions again.

  • If you have any further questions regarding your commission, please contact me via email: [email protected] and forward the copy of your response if you've filled out the form.

  • Refund: In case of desistance, the payment WILL NOT be refunded. (It is recommended that the commissioner needs to be 100% sure before placing an order to avoid the hassle of doing refunds, this includes Paypal's fees for refunds)

  • Chargebacks: If you file a chargeback against me, your right to everything I have ever made for you will be retracted. Also, you will be added to my blacklist, banned from purchasing anything from me, and will notify other artists and to avoid you.

ORDER FORM

  • Send your application through this Google form! With this I can gather all the information I need to get started.

  • I will contact you through your preferred method (this can either be e-mail or social media) to confirm I received your application. We will talk about the quoted price of your custom art piece and discuss your budget if applicable. Then I will ask you about method of payment and send you a payment request (invoice) for the 50% upfront.

  • After the first payment has gone through I will start working on your artwork as soon as possible!

  • During this time, you'll receive an update of the piece after I'm finished with the initial sketch. This is the point where you can still change things up a bit. Keep in mind that during the second feedback round there will only be small adjustments available.

  • The suggested changes will be applied to your piece as I keep them in mind when working on the final product. Then I'll send you a low resolution file for approval & adjust the piece if needed.

  • After final approval I will ask about the remaining 50% of the payment. When I received the final payment I will send you the high resolution file.

  • Cherish your new artwork or give it to a friend! Thank you so much for your support and helping me in realising my dream as a fulltime artist.

  • Commission status will be tracked here !

  • In the form e-mail and Paypal email should be the same. This is to prevent scammers using a different PayPal email for transaction.

  • I'll only work on the commissions that are in the initial invoice.

  • If you have any further questions regarding your commission, please contact me via email: [email protected] and forward the copy of your response if you've filled out the form.
